In case you hadn't seen our messages about this, I wanted to make sure
folks on the 501 Tech Club lists were invited to take the 2008 NTEN
Community Survey

We conduct a survey every year to find out more about who makes up
this nonprofit technology community (think job roles, organization
types and sizes, budget levels, tech-savvyness, etc.) and to also find
out more about which nptech issues are of most interest and concern
for you all (think program/content areas, as well as top
organizational challenges).

What are the suggested procedures for backing up and retaining employee
e-mail files (in our case backups of *.pst files as we do not have our own
mail server)?

How often should copies of the e-mail files be taken and for how long should
they be kept?

Are there legal requirements?

What are other nonprofits out there doing in this regard?

I can't answer the legal question but I can take a stab at the technical
side.  My first thought is that you should get an exchange server and
store emails on the server.  You could use GFI MailArchiver to archive
Emails to another server.

Another option is to use a backup software like Veritas to backup any
*.pst files from each workstation.

Thoughts, yes.  Answers, no.  There is a lot of information coming out
regarding the legal aspects of retaining employee emails.  From what I've
read, it seems as if there are more legal issues and requirements if you
*do* keep copies as opposed to just not keeping them at all.

First, you'd need to develop and distribute a policy on it.  Then you'd need
to stick to the policy.  My suggestion is to pose the question to several
other lists and do some google searches on the topic.  The NAISG (National
Information Security Group) http://www.naisg.org/ could be a good start
point.

I work for a local municipality which is subject to the laws for public
records requests and the rules for record retention. The Commonwealth
sets rules for retention of public records, which includes emails. In
general, most records can be disposed of after 7 years. Records that
pertain to legal actions, policy changes, and votes (town meeting,
elections, commission decisions) are kept forever. See
http://www.sec.state.ma.us/arc/arcrmu/rmuidx.htm for the detailed
details posted by the Records Management Unit. It may help you put
together your policy.

The most important part of our records management has turned out to be
the publication and adherence to policy. When we are approached with
requests for legal inquiries or public records information, we can
provide the policy to set the guidelines for what we will provide.

We use Exchange with GFI Archiver for maintaining email archives.

We use LaserFiche for archival of electronic documents. Each document
includes metadata that indicates the retention time frame.

Cathy,

Email retention is driven by several factors, including your operational needs and regulatory requirements.  The real issue, however, is discovery (your ability to find and produce an email when needed).

Operationally, what is your need to lookup past communications? Do you, for example, consider emails with clients part of their medical record?  How far back do you need to go to recover emails in order to review or document information?

With respect to regulation, most email retention requirements are for businesses and fall under SEC section 17, Sarbanes/Oxley, and other federal and state regulations.  As a non-profit, you major concern is most likely HIPPA compliance.  Under HIPPA, you need to maintain, secure, and be able to transmit medical records, which may include email communications with clients.  The duration should equal the maintenance of your other medical records.  (Note: If you do not communicate with clients regarding medical information via email, then you can likely avoid email retention and discovery under HIPPA).

To determine you retention needs, as mentioned by others, you need to assess the regulatory requirements and then your operational needs.  Draft a concise, clear, specific policy and implement technology that supports the policy while keeping things SIMPLE.  Note that policies like "Keep emails for at least 180 days" and "Keep emails for 180 days" are VERY differnt (the latter implies emails will not be kept on day 181).  

You do NOT need to buy MS Exchange.  Nor do you need to purchase software and hardware to get the retention and discovery capabilities that you need moving forward.

If you have an in-house email server (Exchange or otherwise), services like Google Message Discovery (GMD was Postini Archive Manageer) will meet all regulatory requirements and will manage retention to your policies specifically.

If you have hosted email services, GMD may still be an option as some hosting companies are more capable/willing to include or allow use of the service.

As for your existing PST files.  Some services allow you to import past emails.  Another option is to include the .PST files in your backups.  If you are not currently backing up your PCs, adding them to your network (server) backups may be expensive.  Other options include online backup services that can be as little as $5-7 per month per PC.

We are not in a position to host our e-mail here - I am the only IT person
for five sites and I do not have time to manage an e-mail server.

I already back up the pst files - the issue is how long should I keep e-mail
files? One year? Two?

To determine you retention needs, as mentioned by others, you need to assess
the regulatory requirements and then your operational needs.  Draft a
concise, clear, specific policy and implement technology that supports the
policy while keeping things SIMPLE.  Note that policies like "Keep emails
for at least 180 days" and "Keep emails for 180 days" are VERY differnt (the
latter implies emails will not be kept on day 181).  

You do NOT need to buy MS Exchange.  Nor do you need to purchase software
and hardware to get the retention and discovery capabilities that you need
moving forward.

If you have an in-house email server (Exchange or otherwise), services like
Google Message Discovery (GMD was Postini Archive Manageer) will meet all
regulatory requirements and will manage retention to your policies
specifically.

If you have hosted email services, GMD may still be an option as some
hosting companies are more capable/willing to include or allow use of the
service.

As for your existing PST files.  Some services allow you to import past
emails.  Another option is to include the .PST files in your backups.  If
you are not currently backing up your PCs, adding them to your network
(server) backups may be expensive.  Other options include online backup
services that can be as little as $5-7 per month per PC.

I work for a local municipality which is subject to the laws for public
records requests and the rules for record retention. The Commonwealth sets
rules for retention of public records, which includes emails. In general,
most records can be disposed of after 7 years. Records that pertain to legal
actions, policy changes, and votes (town meeting, elections, commission
decisions) are kept forever. See

posted by the Records Management Unit. It may help you put together your
policy.

The most important part of our records management has turned out to be the
publication and adherence to policy. When we are approached with requests
for legal inquiries or public records information, we can provide the policy
to set the guidelines for what we will provide.

We use Exchange with GFI Archiver for maintaining email archives.

We use LaserFiche for archival of electronic documents. Each document
includes metadata that indicates the retention time frame.

Thoughts, yes.  Answers, no.  There is a lot of information coming out
regarding the legal aspects of retaining employee emails.  From what I've
read, it seems as if there are more legal issues and requirements if you
*do* keep copies as opposed to just not keeping them at all.

First, you'd need to develop and distribute a policy on it.  Then you'd need
to stick to the policy.  My suggestion is to pose the question to several
other lists and do some google searches on the topic.  The NAISG (National
Information Security Group) http://www.naisg.org/ could be a good start
point.

That's definitely one of the questions - is there something already that
legally binds us to retain e-mail for a specified period? And how do HIPAA
regulations fit into this?

The next step is for us to find that out, then based on the answers, create
a policy.

I already do have software (MS supplied) that backs up the pst files to the
server. When we were on Office 2000, I could actually keep the pst files on
the server but with Office 2003, that was a very clunky arrangement, so now
each installation of Outlook 2003 has the pst backup installed.

Each of my sites does backups each day they are open - all but one site has
automated backups.
