Summary: xpath //processing-instruction() returns wrong node

Initial Comment:
project.version=1.3.0dev
project.build=20080716
svn.revision=8000

Using $source/processing-instruction() in .xq file returns a node that is not a processing-instruction element. It appears to be the root node of the document instead.

the attached .zip file contains pi-test.xq that demonstrates this (and 2 other bugs to be filed separately)
